In the state of California, an expungement is a legal procedure by which a criminal conviction is practically erased. Pleading guilty, a “no contest” plea or a discovery of guilt by a jury or judge is set aside and the charges are dismissed altogether. An expungement relieves the accused individual of specific consequences and negative repercussions that result from a criminal action. The prosecution, arrest and verdict records remain in the file and a memo is placed in the record that the conviction has been discharged. The memo in the criminal record, the California Department of Justice and the FBI files show that a plea of not guilty has been entered and the case ordered to be discharged by the court. As is frequently believed, an expungement does not seal or completely get rid of any trace of your criminal records.
